Digital forensics is a rapidly changing environment and completing a Data Protection Impact Assessment (DPIA) will ensure the principles of data protection have been considered in the planning and implementation of new or updated digital forensic activity.

This document provides guidance on when and how to appropriately complete a Data Protection Impact Assessment (DPIA). It supplements the Information Commissioner’s Office guidance on UK General Data Protection Regulation (UK GDPR) adding digital forensic context to the process.

“We’ve produced this document to help digital forensic investigators comply with Recommendation 12 of the Information Commissioner’s Office investigation report into “Mobile phone data extraction by police forces in England and Wales”. Recommendation 12 states that “Police forces should undertake data protection impact assessments (DPIAs) prior to the procurement or roll-out of new hardware or software for mobile phone extraction and processing to ensure compliance with data protection requirements. They should also ensure that up-to-date DPIAs exist for all relevant current processing.”"

This document is not intended to cover the data protection requirements for the end-to-end investigation process outside of digital forensic services.
